talkby lets you turn things you have written about yourself into a chatbot that answers in your voice from a public page at talkby.app/u/yourname. By creating an account or visiting a bot page, you agree to these terms.
Accounts are handled through Clerk. You must be at least 13 years old, provide accurate information, and keep your sign-in credentials safe. You are responsible for everything that happens under your account.
You own everything you put into your bot — Q&A, topics, intro, story, hot take, uploaded PDFs, scraped public URLs, the page design choices you make, and any optional personal facts you choose to provide (birthday, relationship status, partner's name, gender). You grant us a non-exclusive licence to store it, assemble it into prompts, and serve it to people who visit your bot page. We do not sell your content and we do not use it to train any general-purpose AI model. You can edit or delete any of it at any time from your knowledge page or your intro page.
Don't impersonate anyone. Don't upload PDFs, data exports, URLs, or other content that is illegal, defamatory, sexual without consent, or that you don't have the rights to. Don't scrape URLs you don't have permission to redistribute. Don't try to break, scrape, or overwhelm the service. We can suspend or terminate accounts that do.
Free is free for as long as you want. Paid use is handled as a custom Pro agreement: pricing, included usage, payment timing, and any additional commercial terms are confirmed with you by email, invoice, or a separate written agreement before access is granted. If that separate agreement conflicts with these terms, the separate agreement controls for the paid engagement.
Each account has a monthly credit pool and feature limits set by its plan or custom entitlement. AI replies, draft generations, and embedding calls spend credits. Extra credits are manual top-ups added by us after approval or payment, never a stored cash balance, and they are not refundable once granted unless we agree otherwise in writing.
If payment is overdue, usage materially exceeds the agreed scope, or the account is being abused, we may pause paid features, limit credits, or suspend access until the issue is resolved.
Your bot answers using a large language model (currently Google Gemini) on top of the knowledge you provided. It can be wrong, miss nuance, or invent things you never said. Don't rely on it for medical, legal, financial, or safety-critical answers. Anything a bot says is not a binding statement from the person it represents.
We provide talkby“as is.” We don't promise it will always be available, error-free, or fit for a particular purpose. We take reasonable, industry- standard steps to keep your data secure — encrypted transport, access controls on our processors, regular dependency updates — but no online service can guarantee absolute security. In the event of a security incident or data breach, we will notify affected users without undue delay where required by applicable law and cooperate with regulators.
To the maximum extent allowed by law, our total liability for any claim related to the service — including any security incident, data breach, lost content, downtime, or AI output — is limited to the amount you actually paid us in the twelve months before the claim, and never includes indirect, incidental, consequential, or punitive damages. This cap does not affect any rights that cannot be waived under applicable consumer protection law in your jurisdiction.
We may modify, suspend, or discontinue all or part of the service at any time. If we permanently discontinue the service, we will give reasonable advance notice — typically at least thirty days — by email and on the site, and provide a window for you to export your data via the “Download my data” tool in the account modal.
On discontinuation, any prepaid service credit or refund is handled under the written commercial terms we agreed with you. Unused monthly credits and extra credits are not a cash balance and may be forfeit unless that agreement says otherwise.
You can delete your account at any time. We can suspend or terminate accounts that violate these terms. On termination, your bot page stops being served and your content is deleted within thirty days, except where we are required to keep records (e.g. tax and payment history).
We may update these terms when the product changes. Material changes will be announced on the site and, where relevant, by email. Continued use after the change means you accept the new terms.
